Representing the Inspector General of Police, Commissioner Sanneh applied to the court for the matter to be transferred to the Superior Court because it is a capital offence, not bailable, and the punishment is life imprisonment.
The court granted the application and the matter was transferred to the High Court.
Ousainou Bojang, the alleged killer, was charged with the murder of two Police Constables - Sang J. Gomez and Pateh Jallow - by shooting them with a pistol.
Ousainou Bojang, the first accused, was charged together with one Amie Bojang, the second accused.
The first accused was further charged with Prohibition to Acts of Terrorism Contrary to Section 3(1) (c) of the Anti-Terrorism Act Cap 13:01 Volume III Laws of The Gambia 2009.
The particulars of offence indicated that Ousainou Bojang on or about 12 September 2023, at Sukuta-Traffic Lights and diverse places, in the Republic of The Gambia, caused an attack on Police Constables Pateh Jallow, Sang J. Gomez and Ancy Jawo, which was calculated to be an act of terrorism on their lives.
The second accused, Amie Bojang, was charged with accessory after the fact to murder contrary to section 202 of the Criminal Code Cap 10:01 Volume III laws of The Gambia 2009.
The particulars of offence presented in the court reads that the second accused person, Amie Bojang, on or about 12 September 2023, at Sukuta-Traffic Lights and diverse places, in the Republic of The Gambia, knowingly or having reasons to believe that Ousainou Bojang had committed murder, she provided transportation for his exit outside the jurisdiction of The Gambia.
