According to the prosecutor, the accused persons, Emeka Anthony the first accused, Dominic Osinachi the 2nd , Paul Ozima Iwu 3rd , and Ifeanyi Elvis Nwadike the 4th accused, conspired to commit felony, attempted felony and stole D170,000 from two individuals.
The accused are charged with conspiracy to commit felony contrary to section 368, attempt to commit felony contrary to Section 365 of the Criminal Code Cap 10:01 volume 3 laws of The Gambia 2009, and stealing from a motor vehicle contrary to Section 256(C) of the Criminal Procedure Code 10 volume 3 revised laws of The Gambia. They however pleaded not guilty to all the charges.
The particulars of offence revealed that the accused on 30 December 2023 conspired among themselves to commit a felony therein to wit stealing, and on the same day at SeneGambia stole from a motor vehicle marked BENZ 190 Registration number BJL 7O78D a cash amount of D50,000 being the property of one Abdoulie A. Danso.
The offences charged further indicated that the 1st, 2nd ,3rd and 4th accused on 20 January 2024 at SeneGambia and diverse places unlawfully attempted to commit a felony and therein wit attempted to steal D120,000 from one Sheikh Tijan Touray.
However, prosecutor Jallow, told the court that the offence committed by the accused was bailable but applied that the accused should not be granted bail because they are non-Gambians. “Likely if they are granted bail they would flee the jurisdiction,” he said, adding: “Investigations are ongoing on their activities from December 2023 to January and more complainants and witnesses are reporting.”
Meanwhile the accused pleaded for bail, and the presiding Magistrate admitted that the offences charged were bailable but granting them bail would lie at the discretion of the court, which should be exercised judiciously.
Therefore, the magistrate denied the accused bail based on the argument of the prosecutor.
The matter was adjourned till 8 February 2024.
