He was sentenced to a fine of D10,000 in default to serve 14 days in prison on count one for assault. He was also sentenced to a fine of D10,000 on count two for another assault charge in default to serve 14 days in prison. The presiding magistrate declared that both sentences would run concurrently. The convict was ordered to pay a compensation of D25,000 to each of the two victims in default to serve one month imprisonment for each of them, and the compensation will run consecutively. This followed his plea of guilt.
“The convict is a first-time offender according to the prosecutor. He is young and has a future. He accepted the facts as narrated by the prosecuting officer. I will not impose a custodial sentence on the convict but a fine. The court has considered the mitigating factors,” she stated.
The convict had begged the court to temper justice with mercy and further said that he had apologised to one Mathew Mendy.
Prosecutors alleged that the convict on the 4th October, 2025, at Fina’s Bar at Kotu, willfully and unlawfully assaulted one Gaston Gomez by punching him on his face and stabbing him with a broken bottle on his left hand, occasioning him actual bodily harm.
It was also alleged that he willfully and unlawfully assaulted Mathew Mendy by throwing an empty bottle at him, breaking three of his teeth, occasioning him actual bodily harm.
According to the facts narrated by Cadet ASP M. Jaye, the incident happened on the 4th October, 2025, around 22:00hrs when the two victims were at Fina’s Bar. The convict came to the bar but was asked to leave by Gaston, who said that the convict was banned from coming to the bar by the owner. This resulted to a push and pull. “With help from people, the convict was forced to leave which he eventually did. After sometime, the convict opened the door and threw a broken bottle which hit Mathew on his mouth, breaking three of his teeth, and then assaulted Gaston,” the prosecutor narrated.
