Defence continues testimony in AB RENT A CAR case

The defence witness in AB RENT A CAR case, Lamin Touray, who is also the General Manager of the company, on 21 January 2014, continued his testimony on behalf of the defendant, against Seedy Cham, the plaintiff, who sued the defendant for wrongful termination of his services.

Magistrate Jobarteh presided over the case, as chairman of the Kanifing Industrial Tribunal. He was assisted by Mr Cole and Mrs Davies.

Lamin Touray told the tribunal in his testimony that the plaintiff’s picture was on the billboard of the company, adding that it was done willfully by the plaintiff.

He stated that there was no agreement between the plaintiff and the defendant for the plaintiff’s picture to be put on the billboard.

Mr Touray adduced that it was in 2009 when his boss came into the office with the idea of taking a picture of one of the staff to promote trips to Dakar.

He further stated that they asked the staff as to who would volunteer to take a picture and the plaintiff said he would volunteer.

Touray testified that the plaintiff was asked by his boss to go and change his clothes, adding that in his presence, the plaintiff did not ask for any payment.

He further posited that in October 2013, the picture was torn by the winds, adding that the plaintiff never made any claims for payments.

Mr Touray testified that the plaintiff was making bad comments, adding that the other staff were present when the plaintiff volunteered to take the picture.

He said they did not agree with the plaintiff’s claim that he should be paid for putting his picture on the billboard.

Mr Touray denied the plaintiff’s claim in totality.

The case was adjourned till 10 February 2014, for cross-examination by Garba Cham, who is representing the plaintiff.
