State requests more time to settle AKI victims

Counsel for the three defendants in the Acute Kidney Injury (AKI) case has told the Banjul High Court presided over by Justice E. Jaiteh of the state’s request for more time to settle the AKI victims.

The suit is between the victims of AKI and the Medicines Control Agency, the Ministry of Health, and the Attorney General.

The director of the Civil Litigation and International Law Department, Binga D., counsel for the 3rd, 4th, and 5th defendants, Wednesday told the court that they had a discussion with the counsel for the plaintiffs and asked for more time to get back to them.

He added that the state was yet to call them back for further discussion, which was why he said: “We are still asking for more time.”

He, however, asked the court to give them until 26 February 2024 to get back to the victims for the settlement, and the counsel for the plaintiffs agreed to the request.

The counsel for the victims, counsel Farage, considered the state’s request and agreed to give them an opportunity.

It would be recalled that on 18 December 2023, the defence’s counsel stated in court that they had made significant progress with the issue of compensation and the state was looking into it so they could come out with an indefinite position.

However, the plaintiffs’ counsel, Y. Senghore confirmed meeting with the defendant’s counsel and the Attorney General with a view to settling the matter, saying they had not reached any agreement yet and were open to settlement.

On 22 November, the court asked the plaintiffs’ counsel to know how far they had gone with the order of the court that the plaintiffs publish their writ of summons in India since they could not locate the 1st and 2nd defendants. 

Yesterday, counsel Farage presented the copy of the publication in court but due to the unclearprinting of the writings, the court ordered that the original copy be presented.

The case was adjourned till 7 March 2024.
