Prosecutors alleged that the accused, Katim Touray (alias Kartel) and Kaddijatou Bah (at large) sometime in the month of May, 2025, at Bakoteh and diverse places in the Republic of The Gambia, within the jurisdiction of this Honourable Court, they willfully and unlawfully published or put into circulation a nude video of one Awa Ndow through electronic form, WhatsApp and TikTok to several individuals, an act calculated to be inappropriate or damage her reputation.
It was further alleged that without authority or lawful excuse, they shared a naked video of Awa Ndow on social media platform, WhatsApp and TikTok to several individuals.
Katim Touray, who was only the accused person present in court, denied the charges.
DSP Yaya Colley, who represented the IGP, applied for an adjournment to call their first witness to testify. He also applied for the second accused, who is at large, to be issued with a bench warrant.
“Your Worship, I am opposing bail for the accused even though it is his constitutional right by virtue of section 19 and 24 to be granted bail. He is a flight risk. He lives in Italy and has residential permit of Italy and also has a Gambian passport. He will interfere with the other accused and this will jeopardize the prosecution’s effort to arrest her. If the court is minded to grant him bail, he should produce all his travelling and residential documents before the court. He came for the Tobaski and he is about to go back to Italy,” stated the prosecutor.
Lawyer M. L. Drammeh, who represented the accused conditionally, argued that the accused is guaranteed by the constitution under sections 19 and 24 to be granted bail. He stated that the offences charged are bailable. “There is no evidence to show that the accused is flight risk and will interfere with the second accused. We submit that the accused should be granted bail,” adduced the defence counsel.
Among the conditions of bail by the presiding magistrate, the accused should produce two Gambian sureties who should swear to an affidavit of means. They should deposit their ID cards to the registrar of the court. The accused should surrender all his travelling and residential documents to the registrar of the court.
DSP Yaya Colley is expected to make a line-up of his witnesses to testify on the 24 June 2026.
