Three suspects Musa Jallow, Juma Jallow and Modou Jallow were on 1st August 2009 acquitted and discharged by the Brikama Magistrates' Court presided over by Magistrate Fred Foster on a charge of burglary.
Delivering his judgement, Magistrate Foster stated that the charge against the third accused person was that of conspiracy to commit a felony. He said after the analysis of the evidence, the court found that the prosecution has not successfully adduced evidence to prove that the third accused was part of the conspiracy. He therefore acquitted and discharged him.
According to Magistrate Foster, the remaining charge against the first and second accused persons was that of shop breaking. He added that for this count too, the prosecution did not adduce sufficient evidence to prove the element of the charge. He consequently acquitted and discharged the accused persons on a charge of shop breaking.
However, the first and second accused persons were convicted and sentenced to a mandatory jail term of six months on a charge of stealing
