Prosecution case to close if...

The Kanifing Magistrates’ Court, presided over by Magistrate Tabally, recently told the prosecutor to close their case in an alleged theft case and conspiracy to commit felony involving Buba Sarr, Sheirk Omar Faye, Mbai Colley, Oley Jatta, Alieu Mboob, Jali Kasey and Sainabou Faye.

When the case was announced, the prosecuting officer, Ceesay, announced her representation on behalf of CPL 335 Nying.

She told the court that the prosecutor handling the case was attending a workshop and she could not proceed. She craved the court’s indulgence to grant her an adjournment.

The presiding Magistrate Tabally granted the application made by the prosecutor, adding: “If the prosecution fails to proceed with the case on the next sitting, their case would be closed.”

He consequently adjourned the case till 28 June 2011.

According to the particulars of offence on count one, the accused persons, on 23 January 2011, at Lexma Supermarket, along Kairaba Avenue, jointly committed a felony to wit stealing.

Count two states that the accused persons on the same day and place allegedly stole items from the said supermarket worth D12,750.
