It would be recalled that Lamin Ceesay was convicted and sentenced to death by the lower court, and he appealed.
In hearing the appeal, the five-member panel of judges of the Supreme Court of The Gambia set aside the conviction and sentence, andreferred the case back to the high court for a re-trial.
When the case was called, Simon Abi, the deputy Director of Special Litigation at the Attorney General Chambers, announced his representation for the state, while the accused person was represented by the counsel from the Legal Aid agency.
Meanwhile, the state counsel after perusing the medical certificate of the accused person, said he was of the view that Ceesay was not fit to stand trial at the moment.
The trial judge then adjourned the case for ruling.
