In his mitigation plea, he begged the court to temper justice with mercy, adding that he committed the crime unconsciously, as he was drunk at the time.

The charge sheet stated that on 17 September 2014, at Kerr Serign in the Kanifing Municipality, he jumped into the compound of one Muhammed Sowe with intent to commit a felony.
