Cham, who dragged one Ismaila Bah to the Kanifing Magistrates’ Court for owing
her D6,040, being the balance from the sale of a vehicle costing D45,000, was
on 17 August 2015 awarded the sum of D6,040 and costs of D750 by Magistrate
Mbye in a judgment delivered by her.
Sirandu Cham, the plaintiff, in her evidence told the court that she sold her vehicle to the defendant, Ismaila Bah.
Magistrate Mbye said the defendant should have filed a civil suit against the plaintiff, and claim all the expenses he claimed to have spent on the car, but failed to do so; adding that in her evidence, the plaintiff said the defendant sold the car without her consent.
The plaintiff had proved her case against the defendant, the magistrate went on, citing the records of payment made by the defendant to the plaintiff.
