Driver arraigned for multiple traffic offences

A driver was recently arraigned before Magistrate Drammeh of the Kanifing Magistrates' Court, charged with multiple traffic offences.

Yaya Fofana, who pleaded not guilty, was charged with rash and negligent act, causing harm and death, while driving without licence and efficient breaking system.

Fofana was granted bail of D250,000 with two Gambian sureties, who must deposit their biometric ID cards.

The particulars of offence on count one stated that on 1 May 2011, at Altantic Road Bakau, in the Kanifing Municipality, the defendant, Yaya Fofana, drove a Renault truck with registration number BJL 1396B in a rash and negligent manner, thereby causing the death of a man whose identity is unknown.

On count two, Fofana was alleged to have driven the said vehicle and caused harm to one Fatoumatta Jobarteh of Bakau.

Count three stated that he drove the said vehicle with a capacity of five tones when he was licensed to drive only 22 passengers.

Count four read that he drove the said vehicle when the breaking system was not in good order.

The case, at that point, was adjourned till 19 May 2011.
