The Brikama Magistrates’ Court on Monday adjourned the case of conspiracy to commit a felony and willful damage to property involving Alhagie Touray and Yaya Sambou.
The adjournment came following the application made by the state counsel, M.N Jobe.
She said the case was being handled by the police prosecutor, but it was not taken over by the state. She therefore urged the court to adjourn the case to enable them get the file from the police.
However, defence counsel Ousainou Darboe objected to the application made by the state counsel.
Darboe submitted that the state’s decision to take over the case was not made in court, adding that the state was aware of the case all along.
He said that since 16 May 2012, the state had time to get the file and get prepared to proceed with the case.
He then urged the court to allow the witness to continue his evidence-in-chief.
However, the defence counsel’s objection was overruled and the case was adjourned till 11 June 2012, to enable the state to get the case file.
