The trial of one Talibeh Jallow, who was arraigned before magistrate Kayode of the Kanifing Magistrate's Court, charged with shop breaking and stealing commenced with the testimony of the first prosecution witness, one Abdoulie Bah.
In his testimony, PW1, Abdoulai Bah told the court that he is a CID officer attached to Serrekunda Police Station, and that he recognised the accused person.
He revealed that on a certain day he received a complaint from one Arafang Ceesay that someone has broken into his shop and stolen some items.
According to him, during the course of the investigation he received another complaint from one Alieu Sowe, alleging that the accused had stolen his property.
Further testifying, PW1 told the court that during the investigation they realised that the 2nd complainant and the accused had conspired to break the shop of Arafang Ceesay.
He said when he arrested the 2nd complainant, Alieu Sowe and the accused, the 2nd complainant had during the interrogation confessed to him that he conspired with the accused to break the shop.
Officer Bah further adduced that he recovered 13 belts from the 2nd complainant.
Also testifying, the complainant, Arafang Ceesay informed the court that he recognised the accused and could recall on 7th May 2010.
He indicated that someone had broken into his shop and stole some of his properties and when he reported the matter to the police station, he was escorted by some CID officers.
On their arrival at the scene, he stated the CID officers told him that they did not see any act of breaking but they will continue on their investigation.
He said he was later called by one Serign Bah to report to the CID office in Serrekunda, as the accused was arrested with one Alieu Sowe.
He revealed that at the station 13 belts were recovered from Alieu Sowe.
The prosecutor tendered the picture of the recovered items as exhibits.
The case was adjourned to 9th June 2010 for continuation.
