The accused, Nicolas Gibba, was charged on two counts including; threatening violence contrary to section 84 of the criminal code cap 10 :01 vol 3, laws of the Gambia and count two include wilful damage of properties contrary to section 312 of the criminal code cap 10:01 vol. 3 laws of the Gambia.
The statement of offence indicated that the accused on the 19th August 2024, at Busumbala in the West Coast Region, intended to intimidate, annoy and threatened to kill one Lana Jatta and Catherine Gibba with a knife and axe, thereby committing an offence.
It further stated that on the same date on the 19th August 2024, at Busumbala in the West Coast Region, the accused willfully and unlawfully damaged one mobile phone mark iPhone 11 pro max valued at D250, 000 and iPhone xx mark value at D10, 000 by smashing them on the wall being properties of one Lena Jatta and Catherine Gibba, thereby committed an offence.
When the charges were read to him in the language he understood, the accused pleaded guilty to all the charges.
The prosecution, however, raised no objection for the accused person to be granted bail, saying: “The accused suffers from mental illness.”
The prosecuting officer thus sought for an adjournment with a view to enabling him secure the presence of pw1.
Meanwhile, the presiding Magistrate, K.B. Sambou, said: “Hence the accused suffers from mental problems, I therefore order the prison authorities in collaboration with the accused family to ensure that the accused person is taken to the TANKA TANKA Psychiatric hospital.
The case has been adjourned to 11th December, 2024
