State fails to serve registrar of Industrial Tribunal in UTG dismissal case

The state counsel representing the UTG in an appeal case against two former UTG lecturers, Dr. Alieu Gibba and Professor Matarr Njie, who claim wrongful dismissal, failed to serve the registrar of the Kanifing Industrial Tribunal for her to make available the record of proceedings to the High Court. This was made known to the High Court on Tuesday by the state counsel, Abdulmuhsin A. Wakawa. As a result, the case could not proceed.

It could be recalled that the UTG filed an order of mandamus against the registrar of the Kanifing Industrial Tribunal to mandate her to produce and bring before the High Court the record of proceedings in Suit No Kit /CS/235/24 which is the subject of the current appeal.

According to the reliefs of the UTG, the High Court cannot determine the appeal without the record of proceedings of the Kanifing Industrial Tribunal transmitted.

That the UTG has tried all possible means to secure the records but this has proved abortive.

The UTG further stated that the registrar of the Kanifing Industrial Tribunal is by law responsible for preparing and transmitting the records.

The briefs of the UTG indicated that the registrar has failed to transmit the records despite several demands.

The UTG further noted in their briefs that the High Court can compel the registrar of the Kanifing Industrial Tribunal to transmit the records to assist in the expeditious determination of the appeal. Both

Dr. Gibba and Professor Njie filed a lawsuit seeking a declaration that their dismissal, dated 27th November, 2024, was unlawful, unfair, malicious and repugnant to the principles of natural justice, which they argued constituted a breach of their employment contracts.

The case will continue on the 5th November, 2025.
