Judiciary launches Users Committee of High Court Commercial Division

The Office of the Chief Justice in a press released announced the formal launch of the Users committee of the commercial division of the high court which took place on the 1st of April 2026.

According a press release from the Office of the Chief Justice, the Committee brings together representatives from the Judiciary, government and financial institutions, and civil society organizations (CSOs). 

The release states that the primary mandate of the Committee is to promote the efficiency of the Commercial Court and recommend measures to improve the management of commercial cases.

The Commercial Division of the High Court presently comprises Justice G. A. Kwabeng, Justice Yakarr H. Roberts and Justice Sonia E. Akinbiyi. The mandate of the court is to ensure the expeditious hearing and determination of commercial cases. 

The establishment of the court is designed to help reduce delays and enhance confidence in the management of commercial cases which is important for the national development.

In his remarks, the Hon. Chief Justice Hon. Justice Hassan B. Jallow underscored the critical connection between effective dispute resolution mechanisms and investors' investment decisions. He noted that investors are more likely to commit resources to jurisdictions where commercial disputes can be resolved in a timely, transparent and fair manner. The establishment of the Commercial Division is therefore expected to significantly enhance The Gambia's attractiveness as an investment destination.

Justice Omar Njie, who led the study on the establishment of the Commercial Division of the High Court was appointed by the Hon. Chief Justice to serve as the Chair of the Committee, while Mr. Pa Alieu Ndow of The Gambia Bankers' Association serves as Deputy Chair. The Hon. Chief Justice stressed that the inclusive composition of the Committee shows a commitment to stakeholder engagement and collaboration in strengthening the administration of justice.

Additionally, the need for specialized expertise in handling complex commercial matters was highlighted while the Hon. Chief Justice emphasized the importance of adequate funding to ensure the effective functioning of the Commercial Division.

Stakeholders expressed strong support for the initiative, noting that a well-functioning Commercial Court would play a vital role in boosting investor confidence and facilitating economic growth.

The meeting also provided an opportunity for stakeholders to discuss challenges and identify areas for improvement for enhanced performance of the Court. Among the key issues raised were the need for enhanced technological capacity, improved infrastructure, and adequate financial resources.
