In her deliberation, the presiding magistrate told the court that having considered the application made by the prosecution, especially in paragraphs 5 and 6 of the affidavit in support of the motion, the application for the issuance of a bench warrant for the arrest of Mr. Ndimbalan had merits.
“Under the circumstance, the court has granted the application for a bench warrant to be issued against the suspect and brought to court,” she declared. This followed the application made by Sub-Inspector Cherno Baba Jallow.
The prosecuting officer, Sub-Inspector Cherno Baba Jallow, earlier moved an Ex-Parte Motion for the court to make an order for a bench warrant to be issued for the arrest of the suspect, Ibrahima Ndimbalan, who is suspected to be in Senegal or in Sub-Saharan Africa, and to make any further orders as the court may deem fit.
There was also an affidavit in support of the motion deposed to by ASP Amat Touray. In the said affidavit, Prosecutor Touray stated that he deposed to the affidavit with the knowledge and consent of the IGP; that a case file was forwarded from the Senegambia charge office to his office for further investigations; that the suspect was charged with the offence of having firearms without authority, contrary to Section 8 of the Arms and Ammunition Act; that the said firearm belongs to one Ibrahima Ndimbalan who is alleged to be in possession of two-magazine pistol marked RUGER loaded with 6 live ammunitions without a licence; that the suspect’s vehicle was searched by Senegambia PIU personnel and found the said pistol inside the car and the suspect fled the scene; that the driver of the vehicle was arrested; that the suspect, Ibrahima Ndimbalan, is suspected to be in Senegal or Sub-Saharan Africa; that the Interpol requested a warrant in order for their counterparts to effect arrest on the suspect.
The case was subsequently adjourned to the 4th January, 2024.
