2 prominent Senegalese journalists arrested

Two prominent Senegalese journalists, Maïmouna Ndour Faye of 7TV and Babacar Fall of RFM were arrested and detained for interviewing fugitive media owner Madiambal Diagne Madiambal Diagne, who is subject to an international arrest warrant.

The duo is accused of “undermining state security” and “undermining the authority of the judiciary,” a development that has sparked fresh debate over the boundaries of press freedom.

According to Lamine Niang, director general of "Le Soleil," the two journalists should not have defied the authorities.

"We cannot continue to defy the state with impunity. The pen and the microphone grant rights, but above all, they impose responsibilities. Let everyone bear the legal consequences of their positions," Lamine Niang wrote on his Facebook page. It should be noted that Maimouna Ndour Faye, head of 7TV, and Babacar Fall, director of RFM, were taken into custody. Several organisations, such as SYNPICS, reacted by condemning their arrest.

Legal opinions remain divided: some lawyers argue that no law forbids journalists from interviewing individuals sought by the courts, while others point to Articles 5 and 57 of the Press Code, which prohibit disclosing details of ongoing judicial proceedings.

The Council of Press Publishers and Broadcasters of Senegal (CDEPS), the country’s main association of media owners, has condemned the arrests as a serious violation of press freedom and urged authorities to respect constitutional and international protections for journalists.
