Two acquitted on assault charge

Fatou Manneh and Bakary Manneh, who were accused of assault causing actual bodily harm, were recently acquitted and discharged by principal Magistrate Hilary Abeke of the Brikama Magistrates’ Court.

This was after both the prosecution and the defence counsel made their applications before the court.

The police prosecutor, Sub inspector S. Camara, told the court that he needed to withdraw the matter before the court, because since the case was mentioned, he was unable to reach the complainant.

Defense counsel Lamin J. Darboe then applied for the court to acquit and discharge the two accused persons.

In his ruling, the presiding magistrate told the court that since the case was mentioned on 6 October, it had not proceeded.

He said the prosecutor could not produce any witness before the court, and has now informed the court that he had no access to his witness; as a result, he needed to withdraw the matter before the court.

His application was granted and the defence counsel’s application was also granted, and both accused persons were acquitted and discharged, the magistrate declared.
