Alieu Jallow, the general manger of Uncle Sam Security Campany, recently testified before the Industrial Tribunal at Kanifing, chaired by Magistrate Jobarteh.
The company was sued to the Industrial Tribunal by one of their former employees, Musa Fatty, claiming for his annual leaves and wrongful termination.
The defendant testified that Uncle Sam Security was a Limited Liability Company and that he knows the plaintiff, Musa Fatty, who worked for the company from 2000 to 2011.
He told the tribunal the plaintiff held various positions from normal guard to operation manager, adducing that the plaintiff was promoted over the years.
On his conduct, the security boss said that when the plaintiff started as a normal guard he had been trying to prove himself beyond reasonable doubts to be honest, hard working and reliable.
Later in 2011 his behaviour started to change as he involved himself on personal business, Mr Jallow said.
Asked about the plaintiff annual leaves, Jallow told the tribunal that when the plaintiff started as a casual worker, he was entitled to a week leave.
When he was staff, he was entitled to 14 working days as a junior clerk, and as operator manager, he gained 28 working days.
The plaintiff has social engagement to fulfill yearly, he said, noting that he pleaded to himself that during ‘Tobaski’ he would take a week off, as well as during first day of the Muslim calendar.
He indicated that the plaintiff usually has a recitation of the Holy Quran at his home town in Fulladou and he takes between seven to ten 10days.
This was not a written agreement but it was an understanding we have over the years as it prevails,” said the defendant.
He further revealed that according to exhibit D, the plaintiff requested for a leave of six weeks, which was granted.
He stated that in the leave approval, he was told he could face possible extension, but he did not request for an extension,
