Rape suspect sent to EFSTH for examination

The Special Criminal Court in Banjul recently sent one Demba Sowe, a rape suspect, to the Edward Francis Small Teaching Hospital for examination on his erection situation.

The court further ordered that the copy of the order should be served on the prison authorities and the chief medical director at the EFSTH.

When the case was announced, the defence counsel from the Legal Aid told the court that when the accused was earlier giving his evidence-in-chief, he alleged that he did not have an erection and he was currently sick.

The trial judge, after going through the case file, stated that the application made by the defence counsel for the accused to be sent to the EFSTH for examination was supported by the state counsel handling the case.

He said the court had adopted the previous order made by the then trial judge for the accused to be taken to EFSTH for examination, and further ordered that the order shall be served on the prison authorities and the chief medical director.

It could be recalled that the accused, Demba Sowe, was charged with the offence of rape, which allegedly took place in Farafenni in the NBR some time in 2013, a charge he denied.
