Following the no-case-submission made by Defence Counsel, Sidney Riley, Police Prosecutor 319 Jobe told the court that he totally disagreed with the no-case-submission that the prosecution had failed to prove a prima-facie case against the 3rd and 4th accused persons, who were charged with assault.
He stated that the Counsel's submissions did not hold water because the evidence of PW1 and PW2 was corroborated and reliable, and that the exhibits tendered is in support of the prosecution's case.
He further submitted that, PW1 told the court that the 1st accused person was attacking the complainant from the back, while the 2nd accused person gave her a blow on the face. As a result, he said the complainant fell on the ground and the entire accused started hitting her on the body.
At this junction, the prosecution referred the court to the records of the proceedings and urged the court to overrule the submission made by the Defence Counsel, and allow the 3rd and 4th accused persons to enter into their defence.
The case was adjourned to 24th November 2009 for ruling.
