Nigerian jailed for indecent assault

Magistrate Fatou Darboe of the Kanifing Magistrates’ Court yesterday convicted and sentenced one Ismaila Ola, a Nigerian national, to a mandatory jail term of one year in prison.

Ola, who admitted to the offence of indecent assault, was also ordered to pay a compensation of D5,000 in default to serve six months in prison.

In his mitigation plea, he apologised for the act which he described as something accidently, and said it would not happen again.

The facts as narrated by First Class 3084 Ceesay are that, on 26 September 2014 at Latrikunda German, one Isatou Gibba was given information that a tenant at her home normally brings small girls into his house.

On the day of the incident, Gibba went to Ola’s house and knocked on the door, but he did not open. She forced open the door and found the accused and the victim naked. She saw the accused persons fingers inside the victim’s private parts.

She then rushed to Latrikunda German Police Post and reported the matter. The accused was arrested, and the victim was taken to Jammeh Foundation Hospital where she was examined and a medical report was issued.

The charge sheet read that on 26 September 2014, at Latrikunda German in the Kanifing Municipality, the accused, Ismaila Ola, indecently assaulted an under-age girl by inserting his fingers into her private parts.
