One Modou Joof, a resident of Bundung, was yesterday convicted and sentenced to 3-year suspended sentence and if failed, he would pay the fine of D50,000, in default to serve 1 year in prison, by Magistrate Ibrahim Kijera of the Bundung Magistrates’ Court.

The convict, Modou Joof, was charged with stealing one Nokia phone and D240, from the shop of one Alasanna Bah, on 27 August 2013, at LatriKunda Sabiji.

Delivering his judgment, the trial magistrate read the charge pressed against the convict and went through the evidence of the two prosecution witnesses PW1 and PW2, and that of the convict.

He added that he evaluated the evidence of the prosecution and that the evidences of PW1 and PW2 corroborated.

He said the convict did not deny entering into the shop of the complainant, holding that the allegation levelled against the convict was true.

The prosecution had proven its case and found the convict guilty as charged, he said.

The convict, in his plea of mitigation, told the court that his wife is about to give birth and pleaded with the court to temper justice with mercy.
