Magistrate Tabally of the Kanifing Magistrates’ Court recently convicted and sentenced one Abdou Ngum to a fine of D25, 000 in default to serve three years in prison with hard labour.
The convict, Abdou Ngum, who pleaded guilty of the charge, was also ordered to pay D20,000 to the family of the deceased.
According to the charge sheet, the convict on 1st January 2011, along Serrekunda Banjul highway, opposite Gambia Technical Training Institute (GTTI), drove a motor vehicle with registration number BJL 8094 C in a rash and negligent manner, thereby caused the death of one Jarju Sey Jawo.
In his plea of mitigation, the convict told the court to temper justice with mercy, as “the incident happened accidentally”.
“I am a family man with five kids of school-going age,” he said, begging the court to be lenient with him.
However, the trial magistrate, in his judgment, told the court the convict was a first offender and had shown remorse for what he did.
