The lower court in Brikama recently convicted and sentenced one Bafoday Sidibeh to a fine of D10,000 in default to serve one year in prison with hard labour for rash and negligent act, causing death.
When the case was called for judgement, the prosecuting officer, Inspector Touray, informed the court that the victim’s son had signed an affidavit that they wanted to withdraw the case from the court.
However, presiding Magistrate Edward Singhateh told the court that upon the plea of guilt of the defendant, Bafoday Sidibeh, he found him guilty.
He said that since the beginning of the case the defendant had pleaded guilty of the charge and therefore the matter could not be withdrawn from the court.
He consequently convicted and sentenced him accordingly after the convict begged for mercy.
