Principal Magistrate Abeke of the Brikama Magistrates’ Court recently cautioned and discharged one Buba Jarju for the offence of stealing from a dwelling house.
According to the facts of the case as narrated by prosecuting officer Inspector L. Touray, the accused, Buba Jarju, is a security guard working with Maline Security Company and was posted to Paradise Estate, the residence of the complainant, Shampa Roy.
He narrated that on 26 March 2011, between 7p.m and 8p.m the complainant saw a smoke in her house and shouted for help from the accused and the gardener.
Inspector Touray further narrated that both the accused and the gardener went to assist the complainant to put down the smoke, adding that few minutes later the complainant realised that her mobile phone was missing.
The complainant, the prosecutor added, called the attention of the accused and the gardener and confronted them about the mobile, but both denied taking the mobile phone.
He adduced that the matter was later reported to the Old Yundum Police Station, adding that the scene was visited by the CID officers and both the accused and the gardener were arrested for investigation.
“During the investigation, the accused confessed taking the mobile and he led the police to recover the mobile phone,” he further narrated.
The accused admitted the facts of the case as narrated “is true and correct” and was subsequently cautioned and discharged after he pleaded for mercy.
