The particulars of offence stated that in February 2014 at Old Yundum, the accused, Babu Tunka, demolished the cement blocks of one Alpha Marigo and removed his two trips of sand deposited at the plot of land to another place, causing him loss of D22,200.
In his testimony, Trawally told the court that he knew the accused person, and in February 2014 deposited a trip of sand in Alpha Omar’s compound.
When he went back to the said compound, he found that the accused person had removed the sand from the compound.
He reported the matter to the major crime unit in Banjul, and went with a CID officer. They found that accused person had also broken down the other side of the fence of the compound and a pillar, he said.
The accused was later taken to Yundum Police Station, and the CID officer took pictures of the broken fence and he (Trawally) gave his statement to the police.
The case was adjourned to 27 October 2014, for the cross-examination.
