The Kanifing Magistrates’ Court yesterday convicted and sentenced one Pa Cham to a fine of D10,000 in default to serve two years in prison upon his own guilty plea of the charge of breaking into a shop.
The court also ordered that the recovered items be returned to the complainant.
According to the facts of the case as narrated by the prosecuting officer, CPL 3560 Colley, it happened on 8 November 2011, at Bakau New Town.
Colley said that while the convicted person was going with his friend he told the friend to accompany him for an operation in Bakau.
He narrated that the convict went into the complainant’s shop and used an iron bar to break into the said shop, adding that on his way out of the shop with the items, he was intercepted by two men who raised an alarm.
The convicted person was apprehended by the crowd and taken to the Kairaba Police Station with the items, where he was cautioned and charged with the offence committed, the prosecutor told the court.
The charge sheet that was read in court revealed that on 8 November 2011, at Bakau New Town, in the Kanifing Municipality, the convicted person, Pa Cham, broke into the shop of the complainant and therein stole the following: one black plastic bag containing several items ranging from body spray to canned drinks, mayonnaise, tins of sardine, packet of pens, pineapple drinks, electrical accessories and biscuits.
