An official of the National Environmental Agency (NEA), Ebrima Sillah, filed the case against the duo, who are both charged on a single count of selling banned plastic bags contrary to section 9(1) (b) of the ban on Plastic Ban Order, 2015.
NEA alleged that Modou Kha and Ousman Mbye on or before 3rd August 2023 at Brikama in the West Coast Region “willfully and unlawfully” sold banned plastic bags.
Both accused pleaded guilty to the offence.
Kha was subsequently granted bail of D5,000 with a Gambian surety who should deposit a valid ID card or passport pending his sentence.
The prosecuting officer who appeared for the IGP was Mariama Badjie.
Mbye, who was arraigned on a different day, was also granted bail in the sum of D15,000 with a Gambian surety who should provide his or her valid ID card or passport to the registrar of the court.
In a related development, a bench warrant was issued against one Alieu Drammeh by Magistrate David Gomez of the Mansakonko Magistrates’ Court for his failure to appear in court against a charge of importing banned plastic bag contrary to Section 4(a) of the ban on Plastic Bags Order 2015, punishable under Section 9(1a) of the same Order.
Ebrima Sillah, an NEA official, alleged that the accused on or about 3rd August 2023, at Jarra Soma Market in MansaKonko Area Council, “willfully and unlawfully” imported banned plastic bags, without authority, which the official said “is against the laws of the National Environmental Agency”.
Sub-Inspector Camara, the prosecuting officer, applied for the bench warrant, which was granted by the Magistrate, who also ordered that, upon arrest, the accused should be granted bail of D15,000, pending his appearance in court.
