Prosecutor urges court to deny bail to accused for allegedly threatening to kill

Prosecutor Inspector Cherno Baba Jallow, representing the IGP, yesterday made an application to the court to deny bail to an accused person, Abdoulie Sonko, who was alleged to have threatened to kill one Momodou Jallow.

The application was made before Magistrate Camara of the Kanifing Magistrates’ Court.

Prosecutors alleged that the accused on or about 12 June 2026, at Kanifing Estate, in  the Kanifing Municipality of the republic of The Gambia, within the jurisdiction of the court,  willfully and unlawfully intended to intimidate or annoy, and threatened to kill Momodou Jallow with a knife. He denied any responsibility.

Prosecutor Jallow rose and told the court that the accused had threatened to kill people in the Kanifing Estate community. He further stated that he also threatened to kill the Deputy Imam of Kanifing Estate. “Your Worship, the accused was found in possession of a knife as he was being brought to the court. There are many complaints against him at the Kanifing Estate Police Station. Considering cases of stabbing in our communities, I urge the court to grant our application not to grant bail to the accused,” he argued. He cited Section 126 of the Criminal Procedure Act, 2025, to support his argument.

The accused replied that the allegations made by the prosecutor were not true.  The presiding magistrate, however, stated that the offence with which the accused was charged was bailable, after she heard the argument made by the prosecutor.

She subsequently granted bail to the accused in the sum of D100,000 with two Gambian sureties whose age is about 30 years or above. They should also submit their ID cards to the registrar of the court and swear to an affidavit of means. They should make sure that the accused is always present in court when he is needed. She added that if the accused commit a similar offence, his bail would be revoked.

The case was adjourned till 21 July 2026 for hearing.
