Theft convict bound to keep peace

Magistrate Hilary Abeke of the Kanifing Magistrates’ Court Monday handed over a 2-year suspended sentence to one Muhammed Kujabi, who was found liable for the offence of stealing.

According to the trial magistrate, he had listened to the mitigation of the accused person and the court had considered it.

He added that the convict shall not involve in any criminal act within the two years and if he appeared in court again, he would be sent to prison for two years.

In his plea of mitigation, the accused begged the court to temper justice with mercy, saying he was a first-time offender and promised never to do it again.

The facts of the case stated that it happened on 10 April 2013, at Kanifing Estate when the complainant left his house door open and went to the toilet.

He heard some noise and rushed to find out what was happening and he saw the accused run away and enter into another compound.

The accused was apprehended and taken to Kanifing Estate Police where he was cautioned and charged with the offence committed.

He admitted to taking the mobile phone, but he threw it while he was being chased.
