Sira
Wally Ndow-Njie, who is charged with economic crime alongside nine GNPC
officials, was yesterday denied bail again by the high court presided over by
Justice Ottaba of the Special Criminal Court in Banjul.
Delivering
his ruling on the bail application, Justice Ottaba said he had considered the
submissions of both counsel.
He
said the court previously delivered ruling denying the applicant bail, adding
that the application was considered an abuse of the court’s process because
there were no new facts and circumstances presented before the court by the
applicant.
He
added that the court could not serve as an appeal court over its own decision.
However,
he said, a repeated bail application could only be allowed before the same
judge when new facts and circumstances arise.
He
said the application constituted an abuse of the court’s process, hence the
application was hereby dismissed.
After
the ruling, the applicant was seen shedding tears alongside her family as this
was the third time she was being denied bail by the high court, presided over
by Justice O. Ottaba and Justice Ogar respectively.
