Magistrate Abdoulie Mbacke of the Kanifing Magistrates' Court recently entered judgment in favour of the plaintiff, one Pap John in the sum of D16, 225, including cost.
The plaintiff was claiming for the recovery of the sum of D16, 000, being an agreement on a joint business in which the defendant was to pay the plaintiff at the end of every month, which he failed to honour.
In delivering his judgment, the presiding magistrate stated that the court has taken meticulous care to consider the evidence given by the plaintiff, defendant and their witnesses.
He pointed out that the court has come to the conclusion that the plaintiff has proven his case on the balance of probability, and consequently entered judgment in favour of him in the sum of D16, 000 and cost of D225 to be paid within 14 days.
