Camara is claiming for the recovery and possession of a portion of property situated at Janbamjelly village in Kombo South district of the West Coast Region, measuring 60X50X50X50m.
He also claims the sum of D75,000 for the trees damaged in the said plot of land by the defendant, Bakary Demba.
In his testimony, the plaintiff told the court that he has the transfer document from the Alkalo and the area council for the area the defendant encroached.
At that juncture, the plaintiff was shown the transfer document by his counsel, Ousainou Darboe, which he identified before the court.
The said document was tendered without any objection from the defendant.
The plaintiff further told the court that after the transfer from the Alkalo and the area council, he also received another document or certificate of occupancy, for an area measuring 200x300m.
He has a certificate of occupancy for all his 60 plots of land, adding that the land which was encroached into by the defendant was plot number four.
The plaintiff’s counsel again tendered the certificate of occupancy of plot number four, as well as the document from the physical planning authorities, without any objection by the defendant, Bakary Demba.
Camara said he fenced it and fixed the gate, adding that the other part of the land was fenced with sticks and the defendant removed 50 metres of his fence and cut down all the trees that were planted on his land.
He said he was asking the court to give him the portion of the said land that the defendant encroached upon, as well as the cost of the damage of his trees, which is D75,000.
