Magistrate Omar Jabang of the Kanifing Magistrates’ Court recently convicted and sentenced one FabakaryManjang after finding him guilty of house-breaking, stealing and common assault.
In his mitigation plea, defence counsel BSM Conteh begged the court to temper justice with mercy, as the convict was a first-time offender and did not waste the court’s time.
Magistrate Jabang then sentenced the convict on count one to a fine of D2,500 in default to serve three weeks in prison; on count two to a fine of D1,000 in default to serve three weeks in prison; and on scount three to a fine of D1,000 in default to serve one week in prison.
The court also ordered the items to be returned to the complainant.
He was given a period of two weeks to pay the fines, and was to be bailed by a Gambian surety who must swear to an affidavit of means and deposit an ID card.
The charge sheet in count one read that on 22 September 2014, at Kololi in the Kanifing Municipality, he broke and entered into the house of one Masireh Suwareh with intent to commit a felony.
Count two read that he stole one flat-screen tv marked LG valued at D35, 000, one digital camera valued at D6, 000, two tablets marked Luna valued at D29, 000, a laptop marked HP valued at D8,000, laptop marked Packard Bell valued at D20,000, and a DVD player valued D700 and a receiver valued at D2,500.
Count three stated that he assaulted the said Masireh Suwareh by hitting him with an iron on his feet.
