Principal Magistrate Mahoney of the Brikama Magistrates' Court recently ordered one Malick Fatty to pay a compensation of D45,000 or give the complainant another piece of land.
Mr Fatty was said to have obtained the sum of D45,000 from one Abdou Fatty in consideration of a piece of land.
According to the facts as narrated by the prosecuting officer Sgt 1179 Babucarr Camara, it happened some time in the year 2007, when one Abdou Fatty of New Yundum met the mother of the complainant and told her that he saw a plot of land for sale, and she was interested in it. He said from there they discussed the price of the land and agreed at a cost of D45, 000 (Forty-five thousand dalasi). He said the land measured is 30 by 15 metres. Camara told the court that the complainant made a part payment of D25, 000 (twenty-five thousand dalasis) and later completed the remaining amount of D15, 000 (fifteen thousand dalasis). He adduced that the complainant later requested the transfer of the land from the accused which she could not get. Sgt Camara said the complainant reported the matter to the police station, and the police visited the land and found that the land was owned by one Fanta Sanneh.
Magistrate Mahoney later ordered the accused to compensate the complainant the sum of D45, 000 or give him another plot of land before the 31st July 2009.
