Copyright case to be transferred to high court

Magistrate F.L Drammeh of the Kanifing Magistrates’ Court recently told the court that the copyright case involving one Abdou Keita should be transferred to the high Court in Banjul.

This development came when judgment was to be delivered, after both parties finished testimonies before the court.

According to the trial magistrate, “having had a chance to look at the Copyright Act.cap.95.02, I am no longer proceeding with the case on the grounds that section 51 of the said Act vested jurisdiction on the High Court of The Gambia to hear all matters under the said Act.”

Accordingly, she advised the prosecuting officer, Inspector Mballow, to take the appropriate steps to ensure that the charges are filed at the appropriate court.

According to the particulars of the offence, the accused, Abdou Keita, in March 2011, along the Serrekunda Market area, willfully and for profit- making offered for sale or exhibited two produced cassette of Bolongo Daala, a drama group, entitled ‘Babylon by Force’ “Komma Silo” without a licence or authority to do so.
