The Kanifing Magistrates’ Court presided over by Magistrate Ngubeh on 20 June 2011, acquitted and discharged one Landing Darboe, who was alleged to have broken into a building with intent to commit felony.
Before passing the judgment, the trial Magistrate adduced the testimony of both witnesses in the case, adding that the testimony of the prosecution witnesses that an iron bar was used in breaking into the building, was not tendered in court.
He added that PW1’s testimony was not conclusive because he did not see the accused committing the crime.
The evidence of identification by the prosecution witness was poor, he adduced, consequently acquitting and discharging the accused accordingly.
The alleged charge against the accused, Landing Darboe, was that on 9 April 2011, at Serrekunda, he broke into the house of one Musa Taylor with intent to steal.
