In a recorded decision not to prosecute further, also known as Nolle Prosequi, the case of the alleged accused, DPP A.M. Yusuf exercised the powers vested in him by Section 85 (1) (c) of the 1997 Constitution and Section 64 (1) of the Criminal Procedure Code and informed the court that state wanted the case be withdrawn.
He told the court: “The state intends that the proceedings in the indictment against the accused… be withdrawn.”
The accused, Maimuna Jallow, was charged with manslaughter contrary to section 189 of the Criminal Code Cap: 10:01 Vol III Revised Laws of The Gambia, 2009.
According to the particulars of offence, Maimuna Jallow, on 4 October 2023 at around 19:00 hours at Manjai in the Kanifing Municipality of the Republic of the Gambia and within the jurisdiction of the honorable Court,“ caused the death” of her five-month-old breastfeeding baby, Sirajo Jallow, who she “negligently left” with 15-year-old Kadijatou Camara, a minor, knowing that she could not sufficiently care for the baby, which “led to severe health complications and eventually the death” of the baby.
The accused was thus discharged.
