The accused had informed the court that he had a legal representative. “I told the police that I wanted to speak to my lawyer but they refused,” he told the court. The prosecuting officer, Inspector Inna Jallow, stated that she had told the accused to use her phone to communicate to his lawyer but he said that the phone in which he stored his lawyer’s number was not with him. The presiding magistrate then told the prosecuting officer to assist the accused to get in touch with his lawyer.
Prosecutors alleged that Yorro Saidy sometime in July, 2023, at Senegambia, in the Kanifing Municipality of the Republic of The Gambia, he, as a security officer, working with NDEA, took a gun and robbed one Ebrima Sillah of an amount of D60,000.
Inspector Inna Jallow told the court that the offence was a capital offence and attracts life imprisonment. “I am applying to the court to transfer the case to the Special Criminal Division of the High Court and remand the accused at Mile 2 Prison, pending the hearing of the case at the High Court,” she stated.
Magistrate Mben Faal, as a result, granted the application and transferred the case to the Special Criminal Division of the High Court and remanded the accused at Mile 2 Prison.
