Court convicts, sentences man for assault

The Kanifing Magistrates’ Court has convicted and sentenced one Omar Lowe to a fine of D10,000 in default to serve two years in prison for assault and causing actual bodily harm.

Delivering the verdict on 26 February 2024, presiding Magistrate Colley said the punishment of the offence charged was 5 years mandatory term per section 288 of the criminal Code.

Since the accused pleaded guilty to the offence and also a first time offender as confirmed by the prosecutor M.A. Jallow who appeared for IGP, Magistrate Colley convicted Mr Lowe to pay a fine of D10,000  in default to serve a custodial term of two years in prison.

The presiding Magistrate further awarded a compensation of D10,000 to the complainant in the person of Alhagie Ndure; failure of which the convict  would serve 1 year 6 months in prison.

According to prosecutor M.A. Jallow, the convict on the 8th February at Old Jeshwang  in the Kanifing Municipality, willfully assaulted Alhagie Ndure by stabbing him with a knife on his arm and was charged with assault causing actual bodily harm contrary to Section 288 of the Criminal Code Cap 10:01 Volume 3 revised Laws of the Gambia 2009.
