Bafuloto murder suspect remanded at Mile Two

Magistrate Ado Che of the Brikama Magistrates Court on Wednesday ordered that Edward Nzally be remanded at the remand wing of the State Central Prison, Mile Two.

The suspect is facing a murder charge, contrary to Section 187 of the Criminal Code Cap 10:01 volume 111 of the revised edition 2009.

Particulars of offence stated that on the 7th day of July at Bafuloto village in the West Coast Region, the accused with malice caused the death of Yassin Nzally by stabbing him with a knife on his stomach causing his death, thereby committing an offence.

The accused pleaded not guilty to the charge, claiming that he was first assaulted by the deceased, who was his elder brother, hence he also decided to revenge by stabbing his brother with the knife.

At that juncture, the prosecution led by Inspector Kemo Y. Manneh applied for the matter to be transferred to the High Court of The Gambia, saying the lower court lacks jurisdiction to proceed with the case.

Inspector Manneh relied on Section 62 of the Criminal Procedures Code and legal notice number 111 for the matter to be transferred to the High Court.

He equally urged the court to have the accused person remanded at Mile Two Prison Central Prison as the  matter is not a bailable offence.

In his ruling Magistrate Peter Ado Che granted the application made by the prosecutor and thus transferred the matter to the High Court.

Magistrate Che subsequently remanded the accused at the State Central Prison, Mile Two.
