Businessman Modou Turo Darboe, the Chief Executive Officer of Vision Development Foundation has dragged the Ballast Nedam Company to court.
The matter is before the Kanifing Magistrates' Court, where Turo Darboe is claiming the sum of D500, 000, being the amount withdrawn by the defendant from plaintiff’s account at the Trust Bank without instructions, and which cheque was deposited with the defendant during negotiations for the sale or purchase of second hand vehicles, of which contract has not been concluded.
Mr. Darboe is also claiming interest on the above sum at the rate of 30% from 4th February 2010 to date of judgment, and thereupon 4% to the date of payment.
Costs, including legal fees paid to his solicitor, have also been claimed by the plaintiff.
The case that was adjourned for two consecutive occasions could not again proceed yesterday, and was subsequently adjourned to 6th June 2010.
