Man arraigned for stealing

One Ebrima Ndure was recently arraigned before Magistrate Ceesay of the Kanifing Magistrates' Court charged with shop breaking and stealing.

Testifying before the court, the first prosecution witness (PW1), Kawsu Touray, informed the court that he is a police officer attached to the Police Intervention Unit at Kanifing, and that he recognised the accused person and could remember what happened on 9th August 2010.

According to him, on the day in question, he was standing at Safideen at around 5 am when he saw the accused person with plastic bags. He told the court that he then asked him what was inside the bags, and the accused told him it contains medicines and a stand fan that he was going to repair.

He adduced that they followed the accused to his residence, but did not find anything there.

The witness identified the items stolen, and the items were admitted and tendered as exhibits.

Also testifying, the second prosecution witness (PW2), Samba Sey, told the court that he is a health worker, and that they operate a clinic at Bambo called Salem Clinic, and that he recognised the accused person.

He stated that on 9th August 2010, he was in Banjul when he received a call from his neighbour that someone has removed the padlocks and opened the door of the clinic. According to him, he also contacted his business partner Dr. Tamsir, and informed him what had happen. He indicated that Dr. Tamsir then told their driver to visit the scene, and also instructed him to pass through the police station.

Further testifying, PW2 said he also went to the station, and went with a police officer to the scene where he discovered that some drugs and a stand fan were stolen.

He testified that he went back to the station, and his statement was recorded. The said items were later tendered as exhibits.
