The Brikama Magistrates' Court presided over by Magistrate Fred Foster on 1st August 2009 convicted and sentenced one Modou Lamin Tamba to a fine of D5000 in default to serve three months in prison.
He was also ordered to compensate the complainant in the sum of D12, 000 in default to serve six months in prison.
Mr Tamba was said to have assaulted his wife Bintou Lowe by hitting her on the nose, and as a result she sustained some injury.
In his judgement, Magistrate Fred Foster told the court that the convict was charged with the offence of assault causing actual bodily harm. Magistrate Foster indicated that the complainant in her evidence in-chief told the court that she went to a meeting and when she returned, the convict beat her all over her body and also gave her a blow on her nose, and as a result she sustained some injuries.
Magistrate Foster further adduced that the convict's testimony was inconsistent with the actual facts of the incidences. He added that the convict in his defence testimony told the court that he punched her once, but later told the court that he did not know whether he hit her or not because she(the plaintiff) did hold his private part at the time.
