One Jainaba Badjie was recently convicted and sentenced by Principal Magistrate Mahoney of the Brikama Magistrates' Court for pouring hot oil on her grandfather, one Ansu Jarju.
According to the Police Prosecutor, Sgt. 553 Jammeh, the complainant has sworn to an affidavit that he was a grandfather to the accused, and that he wanted to withdraw the matter before the court. He added that the affidavit was tendered in court and also the accused's family members had contributed D5, 000 to compensate the complainant.
He therefore applied under Section 68 of sub section (1) of the Criminal Code for the matter to be withdrawn.
In his ruling, Magistrate Mahoney stated that the charge was read to the accused and she pleaded guilty.
He added that the accused had committed a very serious offence, and therefore the court could not grant the application to withdraw the matter.
Meanwhile, the accused was subsequently sentenced to a fine of D5,000, in default to serve 6 months in prison and she was also asked to keep the peace for a period of two years. If she commits any offence within this period, she will pay a fine of D3,000 and a compensation of D4, 500, in default to serve 6 months in prison.
