When the case was called, state counsel James held brief for the DPP and noted that he had no motion at his disposal, and that the DPP was busy in another court.
He then applied for a stand down, which was refused.
Defence counsel Badou S.M.Conteh in his bail application stated that he had filed a motion dated 25 June 2012, based on the order made by the court.
The motion was seeking an order for the release of the accused person from custody, and was supported by a ten-paragraph affidavit. They intend to rely on the entire paragraphs, particularly paragraph five of their affidavit, he added.
Counsel submitted that based on the order of the court, that before yesterday (Monday) the state should have filed a charge against the applicant after the completion of the investigation, failure of which the applicant shall be granted bail.
He said the state did not comply with the order and, therefore, urged the court to grant bail to the applicant on reasonable conditions.
The case at that juncture was adjourned till 27 June 2012.
