Duo acquitted and discharged

The Kanifing Magistrates’ Court, presided over by Magistrate Tabally on 17 January 2011 acquitted and discharged Sally Gaye and Fatoumatta Ceesay, who pleaded not guilty of the charge of assault.

It would be recalled that the accused persons, whose bail condition was earlier revoked, were remanded in custody.

Pursuance to section 166 of the criminal procedure code, the trial magistrate applied to enter a no-case-to-answer submission for the accused persons.

He further revealed that the testimony of the first prosecution witness complainant Sira Njie, before the court was not sufficient enough to warrant a conviction against the accused persons.

He subsequently acquitted and discharged the accused persons.

According to the particulars of offence, the accused persons, on 13 September 2010, at Manist Restaurant, along

Kairaba Avenue
, jointly and unlawful assaulted one Sira Njie by beating her all over her body with a belt.
